ERO Contract Cleaning (City and County of Dublin)

Application

This ERO applies to all employees working in contract cleaning in the City and County of Dublin who are engaged in the cleaning of the interior of offices, shops, hospitals, factories, stores and other similar establishments.

It does not apply to employees engaged in exterior structural cleaning or to those covered by separate Collective Bargaining Agreements or other EROs. See ERO for detailed definitions of all categories covered.

Remuneration

Minimum Pay

Overtime Rates

Employees are entitled to overtime rates for hours worked after 39 hours on Mondays to Fridays or after their contract hours if these are less. The entitlement is to time-and-a-half for the first four hours and double time thereafter. Saturday overtime will also be at a rate of time-and-a-half for the first four hours and double time thereafter. Sunday overtime is to be paid at the rate of double time for all hours worked.

Conditions of Employment

Working hours

There is no reference to working hours in this ERO. Employers and employees must comply with the rules set down in the Organisation of Working Time Act, 1997.

Rest Periods

There is no reference to rest breaks in this ERO. Employers and employees must comply with the rules set down in the Organisation of Working Time Act, 1997.

Holidays

Annual leave entitlements are in accordance with the Organisation of Working Time Act, 1997. In addition, employees are entitled to a day’s holiday, double time or a day off in lieu in respect of Good Friday.  Payment for Public Holidays shall be in accordance with Part III of the Organisation of Working Time Act, 1997, exclusive of any qualifying number of hours required in that Act.

Sick Pay Scheme

All employees are entitled to be covered by a contributory Sick Pay Scheme (0.5% of basic rate of pay for all employees). Employees may opt into the scheme with effect from the 1st January each year from their employment start date.

The benefit provides employees with 20 per cent of their basic weekly rate for up to six weeks in any one rolling year, subject to certain conditions.

No benefit shall be paid for the first five working days of any illness. A medical certificate must be submitted on the third day of illness and on a weekly basis thereafter.

Miscellaneous

The ERO also provides for special conditions in relation to a death-in-service-benefit and states that employers in the industry will give full consideration to the position of employees who are unemployed as a result of a change of contractor on a site. See ERO for more details.
