This ERO applies to security operatives who provides a security service, meaning a service of a security or surveillance nature , the purpose to protect persons and property and perform one or more of the functions set out in the ERO. It does not apply to managers, assistant managers and trainee managers in the security industry or to employees covered by separate Collective Bargaining Agreements. Hourly rates of minimum pay will vary depending on length of service. Full details relating to statutory minimum rates of pay are set out in the ERO.
Employees are entitled to be paid overtime for hours in excess of an average 39 hours in the roster cycle at a rate of time-and-a-quarter for the first three hours and time-and-a-half thereafter. For Sunday overtime, employees are entitled to be paid double the minimum rate of pay per hour.
There is a Sunday premium set in the Security ERO (for hours worked on Sunday as part of the 39 hour roster cycle). See ERO for details on same.
Employees who work between 9.00pm and 7:00am are entitled to an unsocial hours premium, provided they work at least three hours in that period. See ERO.
Each employer to whom this agreement applies shall ensure that each employee shall have a rest period and break which can be regarded as equivalent to those provided for in Sections 11,12 and 13 of the Organisation of Working Time Act, 1997.
Annual leave and public holiday entitlements are in accordance with the Organisation of Working Time Act, 1997. In addition, regular rostered overtime, averaged over the previous 13 weeks worked prior to the taking of annual leave, is to be included for the purposes of holiday pay, subject to a maximum of 48 hours per week.
Hours worked on public holidays (excluding Christmas Day) will be paid at double time plus 8 hours. Hours worked on Christmas Day will be paid at treble time plus 8 hours.
All employees are entitled to benefit under a non-contributory Sick Pay Scheme after a minimum of two years’ service with their current employer.
No payment is made until after three days absences and employees must produce a certificate signed by a medical practitioner by the fourth day of any absence (and weekly thereafter), specifying the nature of the illness. The employer must be contacted at least one hour before the rostered commencement time on the first day of absence.
