ERO Hotels (Excluding County Borough of Cork, County Borough of Dublin & The Borough of Dun Laoghaire)

Application

This ERO applies to employees in a hotel business throughout the State (excluding County Borough of Cork, County Borough of Dublin and The Borough Dun Laoghaire). Employees must be engaged in either the preparation or service of food or drink, the provision of living accommodation, the retail sale of goods or in work incidental to these categories.

It does not apply to managers, assistant managers, trainee managers, receptionists, head storemen and housekeepers or to employees covered by a separate REA. See ERO for detailed definitions of all categories covered.

Remuneration

Minimum Pay

Rates of minimum pay will vary depending on job type and length of service. Gratuities and tips are not included in the rates of pay.  Full details relating to statutory minimum rates of pay for each job class are set out in the ERO.

Overtime Rates

Overtime shall be paid at the rate of time-and-a-half for overtime. Overtime rates shall be calculated by reference to the hourly rate, which shall be the appropriate weekly rate without board or lodging divided by the declared normal number of hours worked per week.

Sunday Work

Work performed on Sunday, shall be paid for at time and a third. The extra, which is additional to normal pay, will be based on the appropriate rates without Board or Lodging.

When and employee works on a Sunday which is in addition to the 78 hour fortnight he/she shall be paid time plus one half of the rate without board or lodgings.

Where, on the coming into effect of this Order, a more favorable rate of payment in respect of Sunday working than those provided for in the subparagraphs above was payable to any worker, such rate shall continue to be payable to that worker unless otherwise agreed between both the Employer and the Employee and/or their Representatives. (Written records of any such Agreements must be retained by the Employer and copies given to the Employee and /or their Representatives).


Conditions of Employment

Working hours

The normal number of hours for workers aged 18 years and over  in any fortnight shall be 78 hours.

During the season the normal working fortnight shall be any 10 days.  During the off-season the normal working fortnight  shall be 10 days, calculated on the basis of alternate Sundays off.  The "Season" means the period commencing on the Sunday before easter Sunday and ending on the last Sunday in September.

Workers shall be entitled to each week throughout the year to either one early finishing night at 7.00pm or two at 8.30pm. There are separate rules for starting and finishing times, and the maximum number of working hours for young persons.

Rest Periods

All Employees are entitled to breaks and rest periods in accordance with the Organisation of Working Time Act, 1997 or in accordance with the Protection of Young Persons (Employment) Act, 1996, as the case may be.

Holidays

All employees are entitled to paid annual leave in accordance with provisions of the Organisation of Working Time Act, 1997.  Six weeks’ notice of intention to allow annual leave shall be given by employers to their workers. 

Entitlement in respect of Public Holidays will be in accordance with the provisions of The Organisation of Working Time Act, 1997.

Six weeks’ notice of intention to allow annual leave shall be given by employers to their workers.

Where a worker has worked on any public holidays throughout the year, the day off in lieu may be taken consecutively and added to the workers annual leave.

Sick Pay Scheme

There is no reference to a Sick Pay Scheme in this ERO.
