This ERO applies to employees in a hairdressing business in the County and County Borough of Dublin, the Borough of Dun Laoghaire and the Urban District of Bray whether wholly or mainly engaged in hairdressing including operations incidental or ancillary thereto. It includes hairdressers, apprentice hairdressers, beauticians and manicurists. See ERO for detailed definitions of all categories covered.
Hairdressers (other than apprentices) are entitled to be paid a basic wage plus commission on takings. Weekly rates of minimum pay will vary depending on a worker’s job. Full details relating to statutory minimum rates of pay are set out in the ERO.
A record of each employee’s takings must be made available to enable him/her to verify the amount of commission due to him/her each week. There are additional rules in relation to apprenticeships and other jobs covered.
The ERO covers both weekly and daily overtime rates. Employees whose normal working week is 39 hours are entitled to be paid time-and-a-half for time worked in excess of 39 hours in any week (weekly overtime). Employees whose working week is less than 39 hours are entitled to time-and-a-half for time worked in excess of 8 hours in any day (daily overtime). Sunday overtime to be paid at twice the minimum rate otherwise applicable i.e. double time.
The normal number of working hours is 39 per week. The normal number of hours to be worked on any day is 8 hours.
Employees whose hours of work include the hours from 11.30am to 2.30pm are entitled to a break of at least one hour after 6 hours work, in accordance with provisions of S.I. No. 57/1998 Organisation of Working Time (Breaks At Work For Shop Employees) Regulations.
Annual leave and public holiday entitlements are in accordance with the Organisation of Working Time Act, 1997.
All employees who have completed six months’ employment in a hairdressing salon are entitled to benefit under a contributory sick pay scheme.
All qualified personnel to receive a benefit for fifteen weeks where the employee’s income from other sources (such as social welfare payments) does not exceed normal basic pay rate. This applies on a pro rata basis for apprentices. See ERO for more details.
There is no entitlement to be paid for the first three days of illness and employees must produce a medical certificate by the third day of illness (and weekly thereafter). Employees must also inform their employer of their absence before 12 noon on the first day of illness.
