Follow-up on an Inspection

After the inspection has concluded NERA Inspection Services will contact the employer in writing to advise them of the outcome of the inspection. This can be one of the following scenarios.

  • In general, where breaches have been identified, NERA Inspection Services may undertake one or more of the following actions:

    •   Issue a letter to the employer requesting them to rectify the breaches. 
    •   Refer the matter to Legal Services for prosecution
    •   Undertake a further inspection

  • Where arrears of wages are due to employees, the employer is expected to forward in writing confirmation of compliance and evidence that payment has been subsequently made to the employee(s) within one month. Depending on the circumstances the time limit of one month may be extended if the employer can demonstrate to the inspector that there are valid grounds for not complying with the initial deadline.
  • Failure to respond (or inadequate response) may trigger a second inspection together with notice that any breaches (new or continuing) found will be automatically passed to Legal Services for prosecution.
